Your privacy is important to us. This Online Privacy Policy explains how we collect, share, use, and protect personal information when you visit or use this online service and any other online services offered by Mammoth Water PBC (“Mammoth Water”, “we”, or “us”) that link to or reference this policy (collectively, our “online services”). This policy covers Mammoth Water’s online services, including the Mammoth Water website, TAPP H2O website, TAPP H2O mobile application, and Mammoth Water’s branded social media sites or pages, as well as any interactions you may have while viewing content provided through one of Mammoth Water’s digital advertising campaigns.

Our online services are not intended for children under 18. We do not knowingly collect personal information from children under 18 without parental consent.

Mammoth Water reserves the right, at any time, to modify this Privacy Policy.  If we make revisions that change the way we collect, use, or share personal information, we will post those changes in this Privacy Policy.  You should review this Privacy Policy periodically so that you keep up to date on our most current policies and practices.  We will note the effective date of the latest version of our Privacy Policy at the end of this Privacy Policy.  Your continued use of the Platform following posting of changes constitutes your acceptance of such changes.            

Information We Collect

Personal Information

When you visit or use our online services, we may collect personal information from or about you such as your name, email address, mailing address, and telephone number(s). We further collect, from you or from third parties: (a) your property, flow meter, and field data (e.g., field nickname, legal description, crop planted); (b) information about your surface water and/or groundwater rights, certifications, contracts, allotments and/or allocations; and (c) your surface water and/or groundwater use data (“Water Data”).  We may also collect personal information when you voluntarily submit it to us, such as if you sign up to receive promotional communications; participate in one of our promotional sweepstakes, contests, or surveys; post a review; submit a request to our customer service team; interact with our social media pages; or otherwise interact with us or other users through the Services. Personal information may be provided by you directly, or may be provided by your landlord, tenant, or other person in your organization.  We may also collect any payment information you provide to us. Including credit or debit card information or bank routing information.

Usage and Other Information

In addition to the personal information described above, we may collect certain information about your use of our online services. For example, we may capture the location, IP address, or MAC address of the device you use to connect to the online service, the type of operating system and browser you use, and information about the site you came from, the parts of our online service you access, and the site you visit next. We or our third-party partners may also use cookies, web beacons, or other technologies to collect and store other information about your visit to, or use of, our online services. In addition, we may later associate the usage and other information we collect online with personal information about you.

TAPP H2O

For your convenience, Mammoth Water offers you the ability to access some of our products and services through mobile applications and software for our water tracking and reporting service TAPP H2O (“TAPP H2O”). When you interact with us through TAPP H2O, we may collect information such as unique device identifiers for your mobile device, your screen resolution, and other device settings, information about your location, and analytical information about how you use your mobile device. We may ask your permission before collecting certain information (such as precise geo-location information) through TAPP H2O.

Additional Sources of Information

We may also collect information about you from additional online and offline sources including from your water regulatory agency or district (“District”). We may combine this information with the personal and other information we have collected about you under this Online Privacy Policy.

In addition to the personal information that we collect from you directly and automatically, we may receive personal information about you from other third party sources.  For example, we receive personal information from your landlord or the owner/manager of your property, our business partners, social media sites, or companies that provide personal information to supplement what we already know about users.  We may merge or combine such personal information with the personal information we collect from you directly or automatically.

Use of Information

Our primary purpose in collecting personal information is to provide the Services to you.  We may also use personal information for various purposes, including without limitation to:

  • Processing and sending water use reports;
  • Verifying your identity and your eligibility (such as when you access your account information);
  • Responding to your requests and communicating with you;
  • Performing analytics concerning your use of our online services, including your responses to our emails and the pages you view;
  • Understanding your interest and personalize your experience;
  • Providing you tailored content and marketing and promotional messages for our products and services as well as third party products and services;
  • Operating, evaluating and improving our business (including developing new products and services; improving existing products and services; performing data analytics; and performing accounting, auditing and other internal functions);
  • Complying with and enforcing applicable legal requirements, relevant industry standards, contractual obligations and our policies; and
  • For any other purposes that we may specifically disclose at the time you provide or we collect your information.

We may also use and share data that we collect on a de-identified basis (such that it does not identify any individual customers) for various business purposes, where permissible under applicable laws and regulations.

Disclosure of Information

We may share the information we collect from and about you with our affiliates and other

third parties. For example, we may share your information with: Mammoth Water third-party service providers; other third parties to comply with legal requirements such as the demands of applicable subpoenas and court orders; to verify or enforce our terms of service, our other rights, or other applicable policies; to address fraud, security, or technical issues; to respond to an emergency; or otherwise to protect the rights, property, or security of our customers or third parties.

Your Water Data is considered private. We de-identify your Water Data for the purposes of benchmarking and analytics.  Mammoth Water does not share your personally identifiable Water Data except in special circumstances:

  • With those persons, corporations, or other entities to which you consent to release your Water Data;
  • With your District if we suspect, at our sole discretion, that your meter is broken or malfunctioning;
  • With your District for end-of-year reporting purposes;
  • With your District if you requested submission to your District through TAPP H2O;
  • With third parties to comply with legal requirements.
  • To investigate fraud or misuse of the services
  • To otherwise protect or enforce our legal rights

We may share de-identified information with third parties, including without limitation to help deliver products, services, and content that are better tailored to the users of our online services and for other purposes.

Users may recommend other users to join the platform by providing their contact information or selecting friends from a social networking site.  Users may also provide information about other users of the platform such as reviews of the services or products that they received, booking or scheduling information, or reference information.

Security

No method of transmission over the Internet, or method of electronic storage, is fully secure.  We use reasonable physical, electronic, and procedural safeguards designed to protect and limit access to personal information, although we cannot guarantee the security of your personal information. This includes device safeguards and secured files and buildings. Please note that information you send to us electronically may not be secure when it is transmitted to us. We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us.

Updating your Information

Keeping your account information up-to-date is very important. You may review or update certain account information by contacting us via email at hello@tapph2o.com.

Your Choices

You may request access to your personal information by contacting us as described below.  We will grant you reasonable access to the data that we have about you as required by law.  We rely on you to update and correct the personal information contained in your account.  Note that we may keep historical information in our backup files as permitted by law.  If our Services do not permit you to update or correct certain personal information, please contact us as described below. Typically, we retain your personal information for the period necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law.  You may, however, request that we delete your personal information by contacting us as described below.  We will grant a request to delete information as required by law, but you should note that in many situations we must keep your personal information to comply with our legal obligations, resolve disputes, enforce our agreements, or for another one of our business purposes.  Except as provided above, we will delete, aggregate, or de-identify all of your personal information as described in this subsection within the timeframes required by law.

You can stop receiving promotional e-mails by clicking the “unsubscribe” links in the e-mails or by contacting us as described below.  If you decide not to receive promotional e-mails, we may still send you service-related communications, such as those about your Account, to fulfill orders for products and service you have requested, or deliver notifications directly to you through the Platform.

Some web browsers and devices permit you to broadcast a preference that you not be “tracked” online.  At this time we do not modify your experience based upon whether such a signal is broadcast.

International Users

Mammoth Water is based in the United States of America.  If you are from a country outside of the United States of America with laws governing data collection, use, and disclosure that may differ from U.S. law and you provide personal information to us, please note that any personal information that you provide to us may be transferred to the United States of America.  By providing your personal information, where applicable law permits, you hereby specifically and expressly consent to such transfer and processing and the collection, use, and disclosure set forth herein or in the terms of service related to the use of and access to the Services.
